Terms of Service

These Terms govern your access to and use of the websites, macOS software, and SaaS products (the "Services") provided by Tinkersoft ("Tinkersoft", "we", "us"). By using the Services or buying a product, you agree to these Terms.

Merchant of Record: Orders are sold and fulfilled through Paddle, which acts as our authorised reseller and Merchant of Record. Your purchase is therefore also subject to Paddle's Buyer Terms. Paddle handles payment, invoicing, and applicable taxes.

01 Who we are & acceptance

The Services are operated by Tinkersoft, a software business based in Pakistan, contactable at [email protected]. If you do not agree to these Terms, do not use the Services. If you use the Services on behalf of an organisation, you represent that you may bind it to these Terms.

02 Eligibility & accounts

You must be at least 16 (or the age of majority where you live) to use the Services. You are responsible for keeping your account credentials secure and for all activity under your account. Notify us promptly of any unauthorised use.

03 Licence to use our software

Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use our macOS software and to access our SaaS products for your own use. Licences may be subject to per-seat or per-device limits stated at purchase.

04 Restrictions

You may not, except as permitted by law or a specific licence: copy, resell, sublicense, or redistribute the Services; reverse engineer, decompile, or attempt to extract source code; remove proprietary notices; circumvent licensing or usage limits; or use the Services to build a competing product or in any unlawful, infringing, or abusive way.

05 Payments, taxes & billing

Prices are shown at checkout. Payment, invoicing, and collection are handled by Paddle as Merchant of Record; applicable sales tax, VAT, or GST is calculated and collected by Paddle. By purchasing, you authorise Paddle to charge your chosen payment method.

06 Subscriptions & renewals

SaaS products may be offered on a recurring subscription. Unless cancelled before the renewal date, subscriptions renew automatically for the same term at the then-current price, charged via Paddle. You can cancel at any time; cancellation takes effect at the end of the current billing period.

07 Refunds

Refunds are governed by our Refund Policy and Paddle's Buyer Terms. Nothing in these Terms limits any non-waivable statutory consumer rights you may have.

08 Intellectual property

The Services, including all software, content, trademarks, and design, are owned by Tinkersoft or its licensors and are protected by intellectual property laws. Except for the licence granted above, no rights are transferred to you. Feedback you provide may be used by us without obligation.

09 Third-party services

The Services may link to or rely on third-party services (including Paddle, Cloudflare, and Apple). We are not responsible for third-party services, and your use of them is subject to their own terms.

10 Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

11 Limitation of liability

To the maximum extent permitted by law, Tinkersoft will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Services will not exceed the amount you paid for the relevant product in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some may not apply to you.

12 Indemnification

You agree to indemnify and hold Tinkersoft harmless from claims arising out of your misuse of the Services or breach of these Terms, to the extent permitted by law.

13 Termination

We may suspend or terminate your access if you breach these Terms or use the Services unlawfully. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

14 Changes

We may modify the Services or these Terms. Material changes to these Terms will be posted here with a new "Last updated" date. Continued use after changes means you accept them.

15 Governing law

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules, and the courts of Pakistan have exclusive jurisdiction, subject to any mandatory consumer-protection laws of your country of residence.
